Privacy Policy
Nemus AI, Inc. (“Nemus,” “we,” “us,” or “our”) provides the Orbits mobile and related services (the “Service”). This Privacy Policy describes how we collect, use, disclose, and retain personal information when you use the Service, and the choices available to you. By using the Service, you acknowledge the practices described here. If you do not agree, do not use the Service.
1. Information We Collect
We collect personal information that you provide when using Orbits, including your name, email address, and payment details associated with a subscription (processed as described in Section 3). We may also collect usage data, device information, and communications you have with us (for example, when you contact support or submit feedback).
We collect phone numbers you register in the app for text-message features, and the content of text messages sent to the Orbits phone number by you or members of your household.
Where you connect third-party accounts, we also collect information from those accounts as described in Section 5.
2. How We Use Your Information
We use your information to: provide, maintain, and improve the Orbits app and its features; process payments and manage subscriptions; communicate with you about updates, support, and account-related matters; personalize your experience and deliver relevant features; analyze text messages sent to the Orbits phone number, and authorized email and calendar content, to identify events, reminders, and to-dos for your household using artificial intelligence; propose household actions for your review and approval; maintain the security and integrity of the Service; comply with legal and regulatory obligations. We do not sell personal information.
3. Subscription and Payment Data
If you purchase a subscription, payment details are collected and processed securely through third-party payment providers. Nemus AI, Inc. does not store your full payment card information. We retain only limited transaction data (for example, payment status, amount, and subscription term) as needed to manage your account and billing history.
4. Data Sharing
We do not sell your personal information. We share personal information only: with subprocessors and service providers that assist in operating and maintaining the Service, processing payments, providing analytics or cloud infrastructure, delivering and receiving text messages, and performing machine-learning inference, but only for those purposes; when required to comply with law, legal process, or governmental request, or to protect the rights, safety, or property of Nemus, our users, or the public; in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections.
All subprocessors are required to handle personal information securely and only as specified by Nemus AI, Inc.
5. Connected Accounts (Email and Calendar)
Where you authorize Orbits to access a third-party account (including Google, Apple iCloud, or Microsoft), we process the associated content solely to provide the features you enable, including identifying household-relevant messages and events and generating suggested actions for your review. We do not use the contents of connected accounts to train general-purpose or foundation models.
Upon revocation of access or disconnection of a connected account, Orbits will cease initiating new access to that account. Thereafter, any locally cached copies, derived representations, and other artifacts created from that account will be deleted or de-identified in accordance with Section 10, except where retention is required by law, necessary to complete a transaction you requested, or needed to resolve a dispute or enforce our terms. Disconnection of a connected account does not, by itself, constitute deletion of your Orbits account.
6. Text Message Data
When you register a phone number in the Orbits app, you opt in to the text-message feature. Orbits receives and processes text messages sent to the Orbits phone number from registered phone numbers only. Message content is analyzed using AI to identify events, reminders, and to-dos relevant to your household. We store message content and sender information for processing purposes and retain it in accordance with Section 10. We do not read, store, or process messages from unregistered phone numbers. We do not share phone numbers, SMS opt-in data, or message content with third parties or affiliates for their marketing or promotional purposes. SMS opt-in data is shared only with subcontractors and service providers solely to deliver the text-message service to you. You may opt out at any time by removing your phone number in the app settings or by texting STOP to the Orbits number.
7. Subprocessors and AI Processing
We engage subprocessors to provide infrastructure, communications, payments, analytics, and machine-learning inference. This includes large-language-model providers, to whom we transmit only the data reasonably necessary to perform the requested function. We contractually restrict such subprocessors from using customer content to train their models except as required to provide the inference service or as otherwise disclosed and permitted by you.
A current list of material subprocessors is available upon request at contact@tryorbits.com.
8. Household and Children’s Information
Orbits is intended for household use. The account holder is responsible for the individuals they invite and for obtaining any consents required for household members. We do not sell personal information, including information relating to children or household members. We do not use personal information of children for third-party advertising. A parent, legal guardian, or account holder may request access, correction, or deletion of a household member’s personal data by contacting contact@tryorbits.com. We do not knowingly permit children to create an account in violation of applicable age requirements.
9. Your Rights
Depending on your location, you may have the right to: access, correct, or delete your personal data; withdraw consent for data processing (where applicable); request a copy of your data in a portable format; appeal or lodge a complaint with a supervisory authority, where provided by law. To exercise these rights, contact us at contact@tryorbits.com. We may need to verify your identity before fulfilling a request. We will respond in accordance with applicable law.
10. Retention
We retain personal data for as long as your account remains active and thereafter only for so long as reasonably necessary to provide the Service, comply with legal obligations, resolve disputes, enforce our agreements, and maintain the security and integrity of the Service. When personal data is no longer required for these purposes, we delete or de-identify it. We do not retain a separate “quality,” “training,” or “memory” copy of your personal data after a verified deletion request except as described in this Policy.
11. Account Deletion
You may request deletion of your Orbits account by using the in-product controls, where available, or by contacting us at contact@tryorbits.com. Upon a verified deletion request, we will delete or de-identify personal data associated with the account, including household records we maintain, message content we store, connected-account artifacts, and derived AI representations we created from your data, except to the extent we are required or permitted to retain information under applicable law (including backups that are overwritten in the ordinary course, security logs, and records needed for billing, fraud prevention, or legal compliance).
12. Security
We implement administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, or disclosure. No method of transmission or storage is completely secure, and you use the Service at your own risk.
Orbits has completed Google’s Cloud Application Security Assessment (CASA) in connection with access to Google user data. Completion of this assessment does not constitute a guarantee of absolute security.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice by posting the updated policy in the Service or through other reasonable means. Continued use after an update constitutes acceptance except where applicable law requires a different form of consent.
